Do Attorneys Take a Payment Plan?
Yes, most attorneys will take a payment plan depending on the type of case.
In matrimonial and divorce matters, lawyers will usually require an initial upfront retainer (sum of money) and deduct their hours of work and any case expenses from the initial amount. But, matrimonial attorneys will usually work out a payment plan once that retainer is exhausted.
Personal injury cases present a different situation. Attorney will take on a personal injury case on a “contingency” basis. This means the attorney agrees to be paid a percentage of the case if and when the case settles. If the case is dismissed, the attorney will be out of pocket for all the hours of work and effort; however, he or she can still request you pay for an expenses incurred.
